Its' not over till the large lady sings.   Translation: By the time a document is recorded, the landowner, the landman, and the attorney all have their
                                                                        money and the mineral rights are locked up in a box waiting to drill.

Thought if all things recorded were in one place a clearer picture would result.

Mecosta County:  Western Land Services Inc. has been collecting leases since 2008 and assigning them to W.B. Osborn Oil and Gas Operations
                          San Antonio, TX.

Lease Breakdown:  2008/ 8 leases,  2009/ 119 leases,  2010/ 77 leases,  2011/ 5 leases,  2012/ 111 leases  This totals over 300 landowner
                             leases with 16 from 2012 being recorded on 2/4/13. Assignments took place from 2010-2012.

                            This company got 6 or so drilling permits in 2012. Dundee wells in Mecosta (16N-7W) and Osceola.

 Also in Mecosta:   Noticed that at location of Devon well, since June 2012, there have been 10 documents recorded. OG leases, Affidavits,
                            Trusts, Warranty Deed, Discharge.


Roscommon, Tuscola, Mecosta:   After all the leases they have collected from other companies, Devon Energy Production Co since mid 2012, has
                                                 been signing leases as Lessee. 28 leases in Roscommon (22N-2W)  88 leases in Mecosta  43 leases in Tuscola.

                                            A Devon lease:  Tuscola; signed 10/31/12  140 ac. 1/8 Royalty, 5yr./5yr with $100.00 per net acre for last 5 years.
                                                                    Only 1 lease had 5 year option crossed out and initialed. Lease form used:  Micigan Paid Up (3/10).

TIER HYDROCARBON EXPLORATION LLC from Oklahoma City, OK.  (2 pooling orders in Oklahoma, from 2008 and 2009. Tier Hydrocarbon listed as additional owner of drilling units.)Established they are friends of Devon. Interesting both Devon and Tiptop both granted. Notice date instruments signed
These assignments were planned 6 months ago. New partner and/or farm out.

Recorded 2-12-2013 in Tuscola County. Originally signed 9-18-2012.

160+/- leases originally signed by Bay City Energy, most dated June and July 2010. Covers 10N-8/9E, 11N-8/9/10/11E, 12N-8/9/10/1E
           13N-8/9/10/11E, 14N-7/8/10/11E, 15N-8E.

Devon Energy gives to Tier Hydrocarbon Exploration LLC ...an undivided 2.16775% of 8/8ths% of all oil, gas, condensate, distillate and other
          hydrocarbons produced.
           

Tiptop Energy Production US LLC gives to Tier Hydrocarbon Exploration LLC...an undivided 1.08225% of 8/8ths% of all oil, gas, condensate,
         distillate and other hydrocarbons produced.

Devon and Tiptop are giving Tier Hydrocarbon a 3.25%  overriding royalty interest on 160 leases in Tuscola County. The assignment document was
         drawn up 5 months ago. A similar assignment of overriding royalty interest document covering leases in Roscommon between Devon, Tiptop
         and Tier Hydrocarbons was noted on an earlier post. Similar assignments could be happening in Mecosta and other counties.

To get thier 3.25% royalty Tier Hydrocarbon has to have wells drilled and production from those wells. If the timeline for drilling in Michigan is
         sometime in the future, why would this document be recorded at this time?

If you get a ORRI, you record it as soon as you get it. The ORRI goes with the original lease and is good for the term of that lease and is binding in any sale, farm-out, or future assignment. Example( landowner 1/8th royality, xyz 3.25% ORRI. Add them up.. 1/8th = 12.5 % plus 3.25 ORRI =15.75%. Subtract this from 100% leaves a 84.25 % NRI. or 84.25% working interest.

With this interest recorded and there is a producing well drilled a division order will be drafted and your recorded ORRI will be honored. Or if the lease is sold, farmed-out, assigned, or transfered in any way the ORRI will show and be subject to the lease...... If this doesn't answer you question edwards, I will try again.

It looks like Devon is seeking some help. Tier Hydrocarbon is a small company, but their expertise seems to be in finding subtle traps in shale.


Company Description: Tier Hydrocarbon Exploration is the Partnership of David J. Fruit and Keith Downing. Between them they have 49 years of geological experience and expertise. They are proven conventional gas finders and emphasize non-conventional gas and tech applications. Tier was responsible for some of the earliest successful CBM projects in the Arkoma Basin, the Cherokee Shelf and had early pilots in the Forest City Basin. Tier has an ongoing interest and research in a technology application which in certain areas can be of great assistance in locating subtle traps.


One of their ads states:
Our significant plays have been bypassed tight sands, coal bed methane and shale gas. Introduced Continental Resources into the Arkoma Woodford play where we have royalties under some 20,000 acres

Just makes me nervous to see a lease play getting all cleaned up as far as the recording of assignments as edwards reports.  It usually means that the project is going to be shopped around. As far as Tier the assignments , they could be for services already performed........ some day  we shall find out......

Does anyone know if Tier has anything their background that indicates interest and research in the Silurian Geologic period and or "salina salt beds". Just trying to connect their interest to Devon's purported target within the Silurian formation.

The following lease documents were filed in Oceana County between 5-3-2011 and 11-19-2012.

940 total recordings by AMI Land Services.
806 total landowner leases recorded
659 landowner leases signed in 2012
147 landowner leases signed in 2011

The grantee on all leases was AMI Land Services (Traverse City, formed 2009)
All leases assigned to EXOK INC. (Oklahoma City)
Then all/most leases assigned to EXTEX ENERGY PARTNERS LTD (Houston), formed 2005)
Additionally, the royalties were assigned to TK ROYALTY LLC (Oklahoma, formed 2011), Steven D. Bryant (president of EXOK INC) and James W. Wilis (chairman of EXOK INC).

MOST ACTIVITY TOOK PLACE IN 2012.

4 assignment of lease filings in 2013:  from/to;   EXOK INC/ ENTEX ENERGY,  T.S.DUDLEY LAND CO./ EXOK INC (2), AMI LAND SERVICES/ EXOK INC.
   
 

Clayton Energy: 12 landowner leases filed so far in Oceana in 2013. Leases signed 10-8-2012 to 12-15-2012. Recorded 1-17, 2-11, 2-19.

Note: Lease language from a Clayton Energy/ AgriBank lease in Tuscola County dated 7-3-2010.

15 landowner leases recorded by Western Land Services on 4/9/2013. 9 signed in 2013, 6 signed Dec. 2012. All in 16W-7N Sections 8, 9, 20.

Warranty deed recorded on 2/4/2013 between the landowner of Devon well (13N-8W Sec. 20)
and Second Arrow Farms LLC for parcels in Sections 7, 18. (Parcels adjoin Sec. 20)

Oceana County

7 landowner leases recorded by Clayton Energy. 5 on 3/22/2013 and 2 on 4/1/2013. One was signed on 2/16/2013, the rest were signed in Dec. 2012. 13N-16W and 14N-15W.

Still traffic in the Roscommon and Ogemaw deed offices. Petoskey News reported activity in Antrim, Charlevoix, Emmet and Kalkaska from Nov. 2012 to the present.

No ORRI in Mecosta so far for Tier Hydrocarbon Exploration. (ORRI granted to them by Devon and Tiptop in Tuscola and Roscommon counties)

Landowner leases with Kosco Energy. 3 lease recordings on 3/21/2013. Leases signed on 1/3 and 1/7/2013. One landowner, 1,000 acres. 1/8 net royalty. Additional 5 year primary term with payment of $50.00 / acre for second 5 years. Lease form used, Producers '88' Revised 2000. Addendum with 4 items pertaining to surface damage.  13N-9E  Sec. 2,3,10,11,15,22.

Surface to the top of the Traverse Limestone Formation.
Formation below top of Glenwood Member of the Black River Group.

Mecosta County

Lease between Fork Township and Western Land Services. Recorded 4/18/2013. Signed 3/15/2013. 16N-7W  Sec. 20

Roscommon County

Oil/Gas amendments recorded on 3/13/2013, signed on 2/4 and 2/6/2013. Encana and State of Michigan, grantors on both.
