It is difficult for a land owner to win a lawsuit based on a takings case because often the plaintiff has to show a loss of the entire value of a property because of an adverse governmental action.  On the other hand a gas drilling company can show that loss much easier because the entire value of their interest was dependent upon gas drilling be allowed.  I still think the best avenue for redress by the energy companies will be by invoking the Interstate Commerce clause in our US Constitution against the actions of New York State, the DRBC, etc.

Finally a gas company wakes up.  I suppose it's the bankruptcy that forced it.  The assets of the bankrupt entity are worth peanuts until the sGEIS is approved.

>>> As far as I can see the lawsuit is real, not just a rumor.  Typing in the search term "norse energy lawsuit new york state" brought up articles with some particulars.  Attorney Tom West, who I have read about in the context of shale energy in New York, filed the suit on behalf of Norse.  It certainly would be a very good thing if New York would be made to acknowledge reality, that HVHF is a very real and can be done safely, that New York can't function without the gas gotten by that means, and that it's time for New York to become a producer and not just a consumer.  I still believe that much of the endless delay has been due to the reluctance of the energy companies themselves to see yet more production when they are  struggling to sell what they are already pumping out from the rest of the Appalachian Basin.

Will the JLCNY get moving now? I have to say, they are a difficult group to communicate with. They don't answer emails. Their attorney says that there is a board of directors and a committee, but can't find them to contact and attorney will not respond as who to contact. Why can't this be a group effort?

So who are the "funding parties" that West refers to in his affadavit?  West says he isn't being paid by the trustee but rather by independent third parties.

Whoever they are, thank you!  And if they are Tom's employers, then double thank you for putting their money where their mouth is.

As per the article...jlcny refuses to take industry money for the suit.....they want to keep their interests pure. OK that answers that question.

my guess is the  the pipeline owner (Emkey), or the largest creditor (Bradford Energy), but it's just a guess based on who has the most to lose

query: will all of these cases be filed in Albany County? they may never get to the Court of Appeals if the appeals are all decided by the Third Department

 Gunner just hit an unknown nail directly on the head...

 Early this past spring Emkey trucks started to appear along the west side of
 the rt41 north corridor...Williams/Constitution smothered the east side...
 Unlike the BlueStone/DTE folks they did not have a local office but had a
 strong presence...around here that draws serious attention...

 Emkey is the stepchild of the former head of Norse/Nornew...here is where it
 gets real complicated...Norse had prevously snagged a pipeline ROW from about
 70% of thier $5 an acre leasehold without payment...pending production...
 Williams/Constitution pretty much runs along the same path...but stays East...
 of rt41 north...with Emkey running the west ridge...but they both get joined...
 at the hip in Farnham...at about the same place BlueStone/DTE connect to...
 the Millenium...connect those dots...and draw your own conclusions...
